2.2 Unsubscribing from the BERNARDAUD Newsletter

BERNARDAUD will stop sending you its newsletter within a reasonable period of time, which may not exceed 28 days following receipt of your request. 3. SHARING OF YOUR PERSONAL DATA

BERNARDAUD may share your personal data with other companies in the BERNARDAUD group worldwide (hereinafter the "Affiliated Companies") and selected service providers performing functions on behalf of BERNARDAUD: Idéematic, Google, Talentia, Colissimo and FedEx (hereinafter the "Service Providers"). In this respect, any personal data shared between BERNARDAUD and the Affiliated Companies will first be aggregated or anonymized so as to prevent your identification, provided that such an operation is not contrary to the objective pursued by the said sharing.

In such a case, all measures will be taken to ensure that your personal data receives the degree of protection to which BERNARDAUD is bound by virtue of this Privacy Policy and the applicable data protection legislation.

3.1 Service partners

BERNARDAUD may share data concerning you with companies chosen to manage its order shipments, with any delivery company and with any company providing support services. In such a case, BERNARDAUD will only provide these companies with the data strictly necessary for the performance of the services for which BERNARDAUD has requested them.

3.2 Financial institutions and payment processing partners

Payments via the BERNARDAUD Site are made through strictly identified payment solution providers, namely the Crédit Mutuel group and the Authorize.net service, which will process the payment of your order via the payment information you have transmitted to them (see the "Security" section).

3.3 Legal communications

In certain cases and when strictly required and/or authorized by applicable law, or with your consent, BERNARDAUD may communicate your personal data to comply with a legal or regulatory procedure, to obtain legal advice, for the purpose of reducing credit risk, to prevent and detect fraud and/or to protect and defend BERNARDAUD's assets and interests. If you have created a customer profile in one of the BERNARDAUD stores, you can also access, modify or update your data by visiting a store and asking one of our sales staff.

4.1. Right of access

You may obtain from BERNARDAUD confirmation as to whether or not your data is being processed and, where it is, access to said data, as well as the following information:

- The purposes of the processing;

- The categories of data;

- The recipients or categories of recipients to whom the data have been or will be communicated;

- Where possible, the duration of the storage of the data concerned or, where this is not the case, the criteria used to determine this duration;

4.2. Right of rectification

You have the possibility of obtaining from BERNARDAUD, as soon as possible, the rectification of data concerning you which would prove to be inaccurate. You also have the possibility of having incomplete data completed, including by providing a supplementary declaration.

4.3. Right to erasure

You have the possibility of obtaining from BERNARDAUD the deletion, as soon as possible, of data concerning you when one of the following reasons applies:

- The personal data collected is no longer necessary for the purposes for which it was collected by BERNARDAUD;

- You have withdrawn your consent to the processing of this data and there is no other legal basis for the processing;

- You exercise your right of opposition under the conditions recalled below and there is no compelling legitimate reason for the processing;

- The data has been processed unlawfully;

- The data must be deleted to comply with a legal obligation;

- The data has been collected from a minor or a person of full age.

4.4. Right to limitation

You have the right to obtain from BERNARDAUD the limitation of the processing of your personal data when one of the following reasons applies:

- The processing is unlawful and you object to the erasure of your data and demand instead the limitation of their use;

- BERNARDAUD no longer needs your personal data for the purposes of processing, but they are still necessary for the establishment, exercise or defense of legal claims.


4.5. Right to the portability of your data

You may ask BERNARDAUD to receive your data in a structured, commonly used and readable format. When you exercise your right to data portability, you may obtain that your data be transmitted directly by BERNARDAUD to a designated data controller, where this is technically possible.

Your right to the portability of your personal data must not affect the rights and freedoms of others.

4.6. Right to object

Finally, you have the right to object at any time, for reasons relating to your particular situation, to the processing of your personal data. BERNARDAUD will then no longer proceed with the processing of this data, unless it can be demonstrated that there are legitimate and compelling reasons for doing so which override your interests and your rights and freedoms. BERNARDAUD may also keep a copy of this data for the establishment, exercise or defense of legal rights.

5. RETENTION AND DELETION OF PERSONAL DATA

Unless you exercise your right to delete your personal data, BERNARDAUD will keep this data for as long as you remain an active client. To be considered inactive, a customer account must meet the following two conditions: (i) the account must not have recorded any transactions for 36 consecutive months; (ii) the account holder must not have made any form of contact with BERNARDAUD.

BERNARDAUD may keep for archiving purposes copies of communications with users of the Site as well as any response to questions or comments sent to users by its customer service. In such a case, BERNARDAUD will ensure that any personal data is first anonymized.

BERNARDAUD may also retain your personal data after the closure of your customer account solely for fraud prevention purposes in order to identify, present or resolve legal claims. Finally, BERNARDAUD will keep a record of any objection you may have made to receiving the BERNARDAUD Newsletter for a period not exceeding 3 years, in order to avoid contacting you again.

6. SECURITY

BERNARDAUD will take all reasonable measures to protect your personal data against unauthorized access, processing, deletion, loss or use. All financial information you provide on the Site is stored with a selected financial institution. Transactions on the Site are protected by an encryption process implemented by CIC and Authorize.net. Please be aware, however, that BERNARDAUD's commitment to protect your personal data does not constitute an obligation of result, as any transmission of data on the Internet may be potentially intercepted and used by persons other than the intended recipient.

The Site may contain links to third-party Internet sites. BERNARDAUD has no control over the content, the confidentiality and personal data protection policy or the actions of these Internet sites. 7. CHANGES AND UPDATES TO THE PRIVACY POLICY
